Why:
When the state added the mobile massage establishment language to our statute in 2019 they inadvertently changed a few words which changed the law of all establishments. The mistake was found this fall when massage therapy was moved to a new department and the legal team was familiarizing itself with our statute.
The letter of the current law says LMTs need an establishment license at every place they provide a massage - including each out call address you visit, each health fair you set up at, every sporting event you volunteer at, hospitals, nursing homes. It also means those working under cosmetology establishment are no longer working legally. Obviously this is not the intent of the law, and in fact is not congruent with our state regulations.
So, this bill is the solution to bringing statute and regulation into alignment and to ensure the intent of the law. DHHS, Nebraska State Massage Therapy Board, and AMTA-NE are all in favor of this bill and we are hopeful it will pass quickly to ensure all massage therapists are practicing legally again.

I understand this was an inadvertent mistake when adding to statute several years ago and trust you will ensure it is fixed.
